If you watch entertainment news, then you may already know about the custody battle taking place between Kelly Rutherford and her ex-husband. Her ex-husband had custody of their children and took them to Monaco, but she is trying to obtain custody to bring them back to the United States.
These situations can be hard for parents, especially because their children are too far away to see them often. Recently, a judge had ordered the children back to the USA for the summer, but the legal arrangement required the children to return to Monaco with their father in August 2015. When Rutherford didn’t return her children as required, a judge ordered them back to their father.
According to Rutherford’s lawyer, her taking the children and trying to keep them in the USA was a move out of desperation; when the children were first taken from her, the attorney claims that Rutherford’s ex-husband broke an arrangement with an American court. He had said he wouldn’t take any action in a foreign court, but now he has, drawing into question how this breach of a contract can be dealt with.
The two children in the middle of this custody battle are just 6 and 8 years old, both too young, according to the court, to make decisions about whom they want to live. As of now, they’ll be back in Monaco with their father despite the fact that no one in the situation is a citizen of Monaco to begin with. Rutherford has said that the judge made a mistake and will be responsible for anything that happens to her children now that they’re not in the United States.
