Quite understandably, when a couple with children decides to divorce, the issues relating to child custody can become very difficult to sort through. Even in marriage, parents may often disagree about how the children should be raised, and these disagreements can be heightened during a divorce. When it comes to child custody, easy answers can be rare.
Such a situation has entered the headlines recently with the divorce of “Project Runway” host Heidi Klum and her husband Seal. As some Massachusetts readers may know, the pair, who share four children, announced their separation in January. On April 6, Klum proceeded with the divorce by filing the necessary documents. In her papers, she requested that she have primary physical custody and that Seal have visitation rights.
However, Seal has filed a response to those papers. In it, he requested that he and Klum share joint physical custody of their children. That may set the grounds for a vigorous legal battle, although the issue may also be resolved as the divorce proceeds. When parents disagree on custodial rights, it is often left to a judge to decide the matter.
Many Massachusetts parents can likely relate to the custody battle between Seal and Klum. Courts take many different factors into consideration when determining child custody arrangements. While the needs and wishes of the parents are certainly considered, the best interests of the children are always the top priorities. It will be interesting to see how Klum and Seal work out their custody arrangement.
