How Courts View A Proposed Parental Relocation
Under Massachusetts law, child custody and visitation matters are always resolved in what the court considers “the best interest of the child.” In determining whether to allow the relocation of a child, it will closely examine the reasons for the move and the effect the move-away will have on the child.
The proposed relocation must be for what the court perceives to be a legitimate reason, and not just an effort by the custodial parent to deny visitation rights to the noncustodial parent.
It will also review how the move will affect the child. It will consider such questions as:

- How will the child react to loss of contact with the other parent, grandparents, family members and friends?
