If You Are a Victim of Domestic Violence

Domestic violence occurs in all types of households — rich, poor, and middle-class. You, a family member, or a member of your household, do not have to live with abuse or threats.

Victims can obtain a restraining order under Massachusetts General Law Chapter 209A.

The first step is to obtain an emergency or ex parte restraining order from the police. Within 10 days, there will be a court hearing to determine whether the restraining order should be made permanent.

The order can be of three types:

  • a "stay away order" — meaning that the person subject to the order cannot come within a specified distance of you or live in your home.
  • a "no contact order" — the person cannot have any contact, either verbal or in writing, with you.
  • a "no abuse order" — that allows some limited contact but no abuse
  • a combined no contact/no abuse order
